Terms and Conditions

PLEASE READ THESE TERMS OF USE CAREFULLY.

Please read these Terms & Conditions carefully. By enrolling your child or attending any 247 Football program, you acknowledge and agree to these Terms & Conditions.

 

1.       Introduction

 

1.1    These Terms & Conditions, together with any policies or documents incorporated by reference, govern your participation in all services delivered by 247 Football Pty Ltd (ABN 24 664 325 893) (referred to as 247 Football, we, us or our).

 

1.2    These Terms & Conditions apply to all academy activities, including training sessions, programs, clinics, camps, trials, events, competitions, matches, parties, and any related services (Programs), unless a specific Program states otherwise.

 

1.3    These Terms & Conditions are entered into by:

 

1.3.1         the participant (the Player), and

1.3.2         the parent or legal guardian of the Player (the Parent, you, your).

 

1.4    Your attendance or your child’s participation in any Program constitutes acceptance of these Terms & Conditions.

 

2.       Privacy Policy

 

2.1    Your personal information will be managed in accordance with our Privacy Policy, available at www.247football.com.au

 

3.       Eligibility and Registration

 

3.1    By enrolling a Player, the Parent represents that they:

 

3.1.1         are over 18 years of age;

3.1.2         have legal authority to register the Player;

3.1.3         agree to these Terms & Conditions on behalf of the Player.

 

3.2    The Parent is responsible for ensuring the Player complies with all academy rules, behaviour expectations, safety instructions, and coach directions.

 

3.3    The Parent indemnifies 247 Football for any loss arising from the Player’s breach of these Terms.

4.       Medical Fitness

 

4.1    By enrolling, the Parent confirms that the Player is medically and physically fit to participate in soccer training.

 

4.2    The Parent must notify 247 Football of any medical condition, injury, allergy or requirement that may affect participation.

 

4.3    247 Football may refuse participation if safety concerns arise.

 

5.       Behaviour and Participation

 

5.1    247 Football may suspend or cancel enrolment if:

 

5.1.1         a Player behaves in a dangerous or inappropriate manner;

5.1.2         a Parent behaves disruptively;

5.1.3         safety concerns arise; or

5.1.4         these Terms are breached.

 

6.       Fees and Payments

 

6.1    Fees for Programs will be communicated at registration or via official communication channels.

 

6.2    Fees must be paid in full before the Player may attend, unless otherwise agreed in writing.

 

6.3    247 Football may update its Fees from time to time. Changes apply only to future bookings.

 

6.4    Refunds and credits are provided only in accordance with the Cancellation & Refund Policy.

 

7.       Cancellation and Refund Policy

 

7.1    General

 

7.1.1         Bookings are confirmed once payment is received.

7.1.2         Refunds, credits and cancellations follow these Terms.

 

7.2    Cancellations By Parents

 

7.2.1         7+ days before a Program begins: Full refund or credit.

7.2.2         Less than 7 days before: Credit only (at 247 Football’s discretion).

7.2.3         After a Program commences: No refund, except in approved long-term injury cases.

7.2.4         Missed sessions (illness, travel, conflicts, lateness) are non-refundable.

7.2.5         Make-up sessions may be offered at 247 Football’s discretion, subject to capacity.

7.3    Injury/Medical Withdrawal

 

7.3.1         For injuries lasting more than 3 weeks, a Parent may request a pro-rata credit.

7.3.2         Medical documentation may be required.

7.3.3         Credits must be used within 12 months from the date of issue.

 

7.4    Cancellations By 247 Football

 

7.4.1         If 247 Football cancels a session (not weather-related), we will offer a make-up session, credit, or refund.

7.4.2         If minimum numbers are not reached, a cancellation may occur. Refunds or credits will be offered.

 

7.5    Non-Transferability

 

7.5.1         Credits and make-ups are non-transferable without written consent.

 

7.6    Exceptional Circumstances

 

7.6.1         Refund requests outside this policy may be considered but are not guaranteed.

 

8.       Wet Weather and Extreme Weather Conditions

 

8.1    Soccer is an outdoor sport and may proceed in light/moderate rain when safe.

 

8.2    A session may be cancelled due to:

 

8.2.1         Lightning

8.2.2         severe weather

8.2.3         unsafe field conditions

8.2.4         council/venue closures

 

8.3    No refunds are provided for wet-weather cancellations. Credits or make-up sessions will be offered where possible.

 

8.4    Wet weather decisions will be communicated approximately 60 minutes before the session. If no notification is provided, the session proceeds.

 

8.5    Make-up sessions may be:

 

8.5.1         on a different day or time,

8.5.2         at a different venue, or

8.5.3         combined with another group.

 

8.6    Extreme heat sessions may be modified, shortened, or cancelled. Make-ups or credits will be offered.

 

9.       Venue Closures

 

9.1    If a venue provider or council closes a field, the cancellation will be treated as a wet weather cancellation.

 

10.   Collection of Information

 

10.1        247 Football collects personal information required to run Programs safely and effectively, including contact details, medical information, attendance, and (where consent is provided) images and videos.

 

10.2        Information is handled according to our Privacy Policy.

 

11.   Third Party Services

 

11.1        247 Football may recommend or provide access to third-party services (equipment suppliers, medical professionals, venues etc.).

 

11.2        We are not responsible for any issues arising from third-party services, which you use at your own risk.

 

12.   Waiver of Liability, Indemnity and Consent

 

By enrolling your child, you acknowledge, agree and consent to the following:

 

12.1        Media Consent

 

12.1.1                  You consent to 247 Football staff taking photographs or videos of Players during Programs for marketing or promotional purposes.

 

12.1.2                  Parents may take photos/videos only for personal use and must not publish images of other children without their consent.

 

12.2        Acknowledgement of Physical Risk

 

You understand and accept that:

 

12.2.1                  participation in soccer is physically demanding;

12.2.2                  your child must be medically and physically fit;

12.2.3                  you are unaware of any condition that would prevent safe participation; and

12.2.4                  shin pads are recommended for all sessions.

 

12.3        Acceptance of Risk

You acknowledge that:

12.3.1     participation is at your and the Player’s own risk;

12.3.2     injuries, accidents, and incidents may occur (including falls, collisions, environmental factors);

12.3.3     247 Football does not provide Personal Injury Insurance; and

12.3.4     you are responsible for all medical and ambulance costs.

 

12.4        Consent to Medical Treatment

 

12.4.1     If the Player becomes ill or injured during a Program, you consent to 247 Football arranging medical treatment and/or emergency transport at your cost.

 

12.5                         Release and Indemnity

 

To the maximum extent permitted by law, you hereby:

 

12.5.1     release 247 Football and its officers, employees, contractors, volunteers, sponsors, venues and agents from all liability arising from or connected with the Player’s participation; and

12.5.2     indemnify 247 Football and those parties against all claims, expenses, losses or liabilities caused by the Player or arising from their participation.

This indemnity includes 247 Football’s reasonable legal costs.

 

12.6        No Refund – Waiver Confirmation

 

12.6.1     You acknowledge that there are no refunds within 7 days of the start of a Program.

 

13.   Limitations of Liability and Waivers

 

13.1        To the maximum extent permitted by law, 247 Football is not liable for:

 

13.1.1     Injury, illness or death;

13.1.2     Loss of property;

13.1.3     Indirect, incidental or consequential loss;

13.1.4     Loss of profit, revenue, opportunity or goodwill.

 

13.2        Nothing limits your statutory consumer rights under Australian law.

 

13.3        Programs are provided “as is” with no guarantee of development outcomes.

 

14.   Governing Law

 

14.1        These Terms are governed by the laws of New South Wales, Australia.

 

14.2        Any disputes must be brought exclusively in the Courts of New South Wales, Australia.

 

14.3        If these Terms are translated, the English version prevails.

 

 

15.   General

 

15.1        Transfer of Rights – 247 Football may transfer its rights under these Terms to another entity. You may not transfer your rights without consent.

 

15.2        Severability – If any provision is invalid, it will be severed without affecting the remainder.
